Privacy and Cookie Notice

This notice explains how Op. Dr. Birsen Erzincan (“we”), as data controller under the Turkish Personal Data Protection Law No. 6698 (“KVKK”), processes the personal data of patients, prospective patients and visitors who contact us through our clinic, our website (birsenerzincan.com) and our digital channels (appointment form, WhatsApp, e-mail and telephone). This English version is provided for information; in case of any discrepancy, the Turkish version prevails.

1. Personal data we process

• Identity data: name, surname, national ID or passport number, date and place of birth, gender.
• Contact data: address, telephone number, e-mail address.
• Health data (special category): examination, diagnosis, test and imaging results, prescriptions and previous medical records you share with us.
• Appointment request data: the information you send through our appointment form, WhatsApp, e-mail or telephone, including your preferred appointment time and any description of your concern, which may contain health information.
• Photographs: photos you send us for a pre-consultation, or photos taken during your examination (these are health data).
• Insurance and financial data: private health insurance details and payment information.
• Feedback: your comments and evaluations about our services.
• CCTV images: recordings taken in the clinic for physical security.
• Website usage data: IP address, browser and device information, pages visited and interactions on the site. Cookies are stored on your device only if you give consent. If you do not, no cookies are used; however, to measure the effectiveness of our website and ads, cookieless signals that do not directly identify you (such as a page visit or a click on a contact button, together with technical data such as IP address and browser information) are sent to Google. See section 6.

2. Why we process your data

To provide medical diagnosis, treatment and care; to receive and respond to your appointment requests; to comply with legal obligations, including requests from the Ministry of Health; for record keeping, billing and accounting; to answer your questions and measure patient satisfaction; to inform you about our services; to keep our website secure and working; and, with your consent, to produce website usage statistics.

3. Legal grounds

We process your data on the legal grounds set out in Article 5 of the KVKK: compliance with legal obligations; the establishment or performance of a contract (including handling your appointment request); the establishment, exercise or protection of a right; and our legitimate interests (such as website and premises security). Processing via cookies is based on your explicit consent (Art. 5(1) KVKK). Cookieless measurement signals are processed on the basis of the data controller’s legitimate interest (Art. 5(2)(f) KVKK). Health data is processed under Article 6 of the KVKK by persons bound by professional secrecy, for the purposes of preventive medicine, medical diagnosis, treatment and care. We keep your data for the periods required by law and as long as necessary for the purposes above.

4. Who we share your data with

Competent public authorities, including the Ministry of Health; private insurers, at your request; hospitals, laboratories and physicians we work with for your diagnosis and treatment, all bound by medical secrecy; your legal representatives; our lawyers and accountants, limited to what is necessary; accredited clinic management software providers based in Türkiye; and the technology providers we use to run our website, appointment form and e-mail: Cloudflare (website hosting and security), Resend (form delivery), Google Workspace (e-mail) and, with your consent, Google Analytics (website analytics) and Google Ads (advertising measurement). Without your consent no cookies are set; only cookieless measurement signals are sent to these services. Some of these providers have servers outside Türkiye; such transfers are carried out in accordance with Article 9 of the KVKK.

If you give your explicit consent through the Patient Consent Form provided at our clinic, we may also communicate with you, including about your health, via WhatsApp and e-mail.

5. Your rights

Under Article 11 of the KVKK, you have the right to learn whether your data is processed and request information about it; to learn the purpose of processing and whether it is used accordingly; to know the third parties to whom it is transferred in Türkiye or abroad; to request correction of incomplete or inaccurate data; to request deletion or destruction under Article 7; to request that third parties be notified of such correction or deletion; to object to a result against you arising exclusively from automated analysis; and to claim compensation for damage caused by unlawful processing.

You can send your request in writing to our address above, via registered e-mail (KEP) to [email protected], or by e-mail to [email protected] from an e-mail address you have previously shared with us, using the subject line “KVKK Application”. Your request must include your name, signature (for written requests), ID or passport number, address and the subject of your request. We will respond free of charge within thirty days at the latest.

6. Cookies

• Necessary storage: we store your cookie choice in your browser (be-consent, local storage) so that we do not ask again. Our hosting provider, Cloudflare, may use technical security cookies to protect the site.

• Analytics cookies (only with your consent): if you click “Accept”, we use Google Analytics, which sets the cookies _ga and ga<ID> (2 years) to measure pages visited, traffic sources, device type, approximate location and interactions such as clicks on phone, WhatsApp or e-mail links and appointment form submissions. The contents of the appointment form are never sent to Google Analytics. If you do not consent, these cookies are not set.

• Advertising measurement cookies (only with your consent): we use Google Ads cookies (_gcl_au and _gcl_aw, 90 days) to measure whether visitors who arrive through our Google ads take a contact step such as submitting the appointment form or clicking our phone or WhatsApp links. _gcl_aw stores the click information of a visit that arrives by clicking an ad, so that contact steps can be matched to the ad. These cookies run only if you click “Accept”. They are not used for personalised advertising or remarketing, and the contents of the appointment form are never sent to Google.

  If you do not give consent, no cookies are stored on your device. However, to measure the effectiveness of our website and ads, cookieless signals that do not directly identify you (such as a page visit or a click on a contact button) are sent to Google. These signals are not used for personalised advertising.

You can change or withdraw your consent at any time using the “Cookie settings” link at the bottom of every page, or by deleting cookies in your browser.
